30.05.2019 The Appellant has preferred this appeal against the order dated 26th April, 2019 passed by the Adjudicating Authority (NCLT), Single Bench, Chennai, which reads as follows:
“Counsel for the Applicant is present. It has been submitted that this Bench on 24.04.2019 has initiated the CIR process against the Corporate Debtor. Therefore, the Applicant is directed to file the claim before the IRP without making any delay. Accordingly, the application stands disposed of.”
From the aforesaid order, it is clear that the Appellant is allowed to file the claim before the ‘Interim Resolution Professional’ and there is no cause of action to prefer this appeal under Section 61 of the ‘I&B Code, 2016. At this stage, learned counsel for the Appellant sought permission to withdraw the appeal. Dismissal of the appeal as withdrawn.
