The Central Government through Ministry of Corporate Affairs (“MCA”) notified on March 13, 2020 constitution of the Chennai Bench of the Hon’ble National Company Law Appellate Tribunal (“NCLAT”) for southern Indian states / UT of
- Tamil Nadu,
- Andhra Pradesh,
- Lakshadweep, and
NCLAT was constituted under Section 410 of the Companies Act, 2013 for hearing appeals against the orders of National Company Law Tribunal(s) (NCLT), with effect from 1st June, 2016
At present NCLAT is functioning through four Courts situated at New Delhi. Justice SJ. Mukhopadhaya, the first Chairperson of NCLAT has last year in a conference discussed the need for a Chennai Bench of the NCLAT given that the litigants from southern India face travel concerns, time and costs issues.
MCA has clarified that the Bench of the NCLAT at New Delhi shall be known as the Principal Bench of the NCLAT which shall continue to hear appeals from other parts of India except those falling under the jurisdiction of Chennai Bench of the NCLAT.
