In this article, we have written the step by step procedure of e-filing of Listing of Urgent Matters before Supreme court, National Company Law Appellate Tribunal (NCLAT) and National Company Law Tribunal (NCLT).
In case of Supreme Court, the following directions issued by the Hon’ble Chief Justice of India:
- The E-Filing is for Advocates-on-record (AOR) registered with the Supreme Court of India and the Petitioners-in-Person.
- AOR’s are required to register his/her E-mail ID and Phone number one time with the Computer Cell by submitting a specimen signature form available on the website.
- In the “first instance”, the Petitioner/Respondent-in-Person must register on the website by providing the required details.
- These practice directions will not affect the procedure for regular filing of cases in the Supreme Court of India.
In case of NCLAT, Ministry of Home Affairs Order No.40-3/2020-DM-I(A) (Guidelines) dated 15th April, 2020 and as ordered by the Hon’ble Acting Chairperson, the Court work in the NCLAT shall remain suspended till 3rd May, 2020. However, the urgent cases/matters may be taken up as per directions issued earlier.
In case of NCLT, Notification dated 21.04.2020 notifying that in view of seriousness of pandemic novel coronavirus (COVID-19) the urgent matters at NCLT Benches shall be heard through video conference w.e.f 21.4.2020 till the lockdown ends.
